Terms & Conditions

1. Introduction

These Terms and Conditions ('Terms') govern the provision of home care services by Alaria Home Care, LLC ("Alaria," "we," "us," or "our") to clients and their authorized representatives ("Client," "you," or "your"). By engaging our services or executing a Home Care Service Agreement with Alaria Home Care, you agree to be bound by these Terms. 

2. Services

Alaria Home Care provides non-medical personal care services as described in the Home Care Service Agreement and care plan developed for each individual client. Our services do not constitute medical care, skilled nursing, or any service requiring a professional medical license. Alaria Home Care is not a licensed home health agency. All caregivers are W-2 employees of Alaria Home Care, LLC.

3. Service Agreement & Care Plans

Prior to the commencement of care, all clients or their authorized representatives must execute a Home Care Service Agreement. A care plan will be developed following the Initial Care Assessment. Care plans are reviewed every 60-90 days and may be updated at any time based on changes in the client's condition or needs. Clients or their representatives must notify Alaria of any significant changes in the client's health or care requirements. 

4. Rates & Payment Terms

Current service rates are provided with your Home Care Service Agreement packet. Rates are subject to change with 30 days written notice. Invoices are issued weekly and due within 5 calendar days. A deposit equal to two weeks of projected seervice hours is required before care commences. A valid credit or debit card must be maintained on file at all times. Alaria Home Care reserves the right to pause services for accounts more than 10 days past due. 

5. Cancellation Policy

Cancellation or rescheduling of any scheduled visit requires 24 hours advance notice to avoid charges. Cancellations with less than 24 hours notice will be billed at 100% of the cost of the scheduled visit, subject to a 3-hour minimum. Cancellations due to documented medical emergencies are reviewed on a case-by-case basis. 

6. Holiday Rates

Services provided on designated holidays (New Year's Day, Memorial Day, Juneteenth, Independence Day, Labor Day, Veteran's Day, Thanksgiving Day, and Christmas Day) will be billed at 1.5 times the standard hourly rate. Clients will be notified of upcoming holiday scheduling and rates no later than one week in advance. 

7. Client Responsibilities

Clients and their authorized representatives agree to: provide a safe working environment for Alaria caregivers; notify Alaria promptly of any changes in the client's health, needs, or living sittuation; reate all Alaria staff with dignity and respect; and provide accurate information on all intake forms and assessments. Alaria Home Care reserves the right to terminate services if a client or family member creates an unsafe or hostile environment for our caregivers. 

8. Caregiver Conduct & Assignments

Alaria Home Care will make reasonable efforts to maintain consistent caregiver assignmnets. Alaria reserves the right to reassign caregivers as needed based on operational requirements, caregiver availability, or documented client requests. Clients and families may not directly hire, solicit, or employ Alaria caregivers independently during or within 12 months of the termination of the service agreement. 

9. Limitation of Liability

Alaria Home Care, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the provision of services. Our liability is limited to the direct cost of the services provided. Alaria Home Care maintains general and professional liability insurance and workers' compensation coverage for all employees.  

10. Termination of Services

Either party may terminate the service agreement with two-week's (14 days) written notice. Alaria Home Care may terminate services immediately in the even of non-payment, client safety concerns, or breach of these Terms. Upon termination, the deposit on file will be applied to any outstanding balance; any remaining deposit will be returned within 12 business days. 

11. Privacy & Confidentiality

Alaria Home Care respects the privacy of all clients and complies with applicable federal and state privacy laws. Client information will not be shared with third parties without written authorization except as required by law. 12. Dispute Resolution

Any dispute arising under these Terms shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to mediation before any legal action is pursued. These Terms are governed by the laws of the Commonwealth of Pennsylvania.

13. Amendments

Alaria Home Care reserves the right to amend these Terms with 30 days written notice to active  clients. Continued use of our services following notification constitutes acceptance of the amended Terms.
